Warranty

1. Lifetime Limited Warranty

For as long as Patiofyre remains in business and the product remains in production, Patiofyre warranties each and every product to be free of manufacturing defects, and we will repair or replace, at our option, any genuine Patiofyre product or part sold by Patiofyre or an authorized dealer that is deemed defective. Patiofyre does not warranty its products against normal wear and tear or misuse. If your Patiofyre product was damaged due to misuse, our customer service team can analyze the damage and may be able to suggest options for the customer to remedy. We do not warranty the glass tube or the pellet cartridge in the case of normal wear and tear and/or breakage. This warranty does not include freight charges connected with the shipments for the replacement of defective parts.

2 Limited Warranties

Patiofyre warranties its registered products for regular wear and tear for a period of 3 years from the date of purchase, except Patiofyre does not warranty its removable cartridge product nor the glass tube for regular wear and tear and/or breakage. This warranty does not include freight charges connected with the shipments for the replacement of defective parts.

3. Exclusions & Disclaimers

Patiofyre does not warranty any of its products for acts of God or for consumer error, abuse, neglect, mishandling, misuse or accident. However, if a product is unable to be repaired due to incidental mishandling or misuse, Patiofyre may (in its sole discretion) offer you the option to purchase a replacement product for up to 50% off of the MSRP price listed on the Patiofyre website (not including any sales, promotional, or other discounted prices).

Except for the provided warranties, all Patiofyre products are sold as-is, and Patiofyre explicitly excludes and disclaims all implied warranties, including but not limited to any implied warranty of merchantability or implied warranty of fitness. 

All warranties shall be void if the unit is not assembled or operated in accordance with the assembly and operational instructions provided with this unit; the unit is resold or traded to another owner; components, accessories, or fuels not compatible with the unit have been used; the unit has been used in commercial or food service application; or the user has abused or otherwise failed to maintain the unit.

4. Warranty Process

Warranty claims may only be submitted for products purchased from Patiofyre and authorized retailers including orders placed on, through, or from Patiofyre.com, and registered with Patiofyre’s Product Warranty Registration. To submit a warranty claim, see Section 5 below.

Patiofyre aims to make a warranty decision within thirty (30) days of receiving your warranty claim or receiving the product for repair or replacement, whichever is later. Patiofyre will perform any obligations under the warranty, if any, within thirty (30) days of communicating its decision regarding the warranty or within sixty (60) days of receiving the warranty claim, whichever is later.

6. Disputes & Legal Remedies

Patiofyre hopes for customer satisfaction, and Patiofyre will work in good faith to resolve any and all disputes. Any remaining unresolved disputes shall be resolved through binding arbitration through the Arbitration Services of Portland pursuant to the following terms:

Any dispute, controversy, complaint, or claim with Patiofyre (specifically including, but not limited to anything related to the terms of Patiofyre’s Warranty, the Terms and Conditions, Terms of Sale, Privacy Policy, or otherwise related to your use of the Sites or any Patiofyre product)  any will be settled by arbitration before a single arbitrator in Bend, Oregon. The arbitration will be initiated by filing a claim with the Arbitration Services of Portland, and will be conducted in accordance with the then-current rules of the Arbitration Services of Portland.

If you and Patiofyre agree on an arbitrator, the arbitration will be held before the arbitrator selected.  If you and Patiofyre do not agree on an arbitrator, you and Patiofyre will designate an arbitrator and the arbitration will be held before a third arbitrator selected by the designated arbitrators. 

The resolution of any dispute, controversy, or claim as determined by the arbitrator will be binding.  Judgment on the award of the arbitrator may be entered by any party in any court having jurisdiction. 

You or Patiofyre may seek from a court an order to compel arbitration, or any other interim relief or provisional remedies pending an arbitrator’s resolution of any dispute, controversy, or claim.  Any such action, suit, or proceeding will be litigated in courts located in Deschutes County, Oregon.

7. Attorneys’ Fees

In the event of any action or proceeding brought to enforce or otherwise concerning the terms of this Warranty, Privacy Policy, Terms of Use, Terms of Sale, or arising out of your use of the Sites or any Patiofyre product, the prevailing party of such dispute shall, to the extent permitted by applicable law, be entitled to recover costs, including but not limited to, reasonable attorneys’ fees incurred.
